Introduction

These Terms of Service govern your access to and use of animaker, including our website, account system, video generation tools, payment features, credits, and related services.

By using animaker, you agree to these Terms. If you do not agree, please do not use the service.

Service Description

animaker lets users upload a portrait photo and a reference video to generate a new motion video. The service may include account features, credit-based generation, task history, downloads, and related tools.

Generated output depends on the quality of uploaded materials, system availability, third-party providers, and technical limits. We do not guarantee that every generation will meet a specific creative expectation.

animaker is an interface, not a model. We do not build or train the underlying media generation models ourselves — video generation is carried out by third-party AI models and GPU infrastructure we integrate with, selected per task, and every job is also subject to those platforms' own content review.

Accounts

You are responsible for providing accurate account information, maintaining the confidentiality of your login credentials, and all activity under your account.

You must notify us promptly if you believe your account has been accessed without authorization.

User Content

You retain the rights you hold in photos, videos, prompts, generated videos, and other content you upload or create through animaker.

By using the service, you grant animaker the limited rights necessary to host, process, transmit, store, display, and deliver your content solely for operating, securing, supporting, and improving the service.

You are responsible for ensuring that you have the rights and permissions needed for any content you upload or generate.

Acceptable Use

You agree not to use animaker to:

• Violate applicable laws or regulations
• Upload content you do not have rights to use
• Infringe intellectual property, privacy, publicity, or other rights
• Create abusive, deceptive, harmful, or unlawful content
• Interfere with or disrupt the security, integrity, or performance of the service
• Attempt to bypass limits, authentication, payment, or security controls
• Reverse engineer, scrape, resell, or misuse the service in an unauthorized way

You must not use animaker to generate, upload, or attempt to generate:

• Sexual, nude, or sexually suggestive content of any kind
• Any sexualized content involving minors
• Sexual or intimate imagery of an identifiable person without their consent
• Content that impersonates a real person or organization in a misleading way, including public figures

These examples are not exhaustive. Our Acceptable Use Policy sets out the full rules and how we enforce them.

Non-consensual intimate imagery (NCII)

animaker must not be used to create non-consensual intimate imagery, or any sexual or intimate depiction of a real person, whether or not that person is a public figure. Uploading someone else's photo to produce sexual, nude, or intimate content violates these Terms and our Acceptable Use Policy; we remove the output and suspend the account.

animaker integrates with Google Sign-In. We do not use Google APIs, Google account data, or any other Google service to generate NCII or any sexual content, and we do not permit users to do so through animaker.

Credits, Pricing, and Payments

animaker uses a credit-based generation model. One credit creates one video generation request unless otherwise stated at checkout or in the product interface.

Prices, product packages, credit validity, and payment methods may change over time. The current checkout page or pricing page controls the terms of a purchase.

Payments are processed by third-party payment providers. By purchasing credits, you agree to the applicable payment provider terms.

If a generation task fails because of a processing error on our side, the consumed credit is returned to your account automatically. That is separate from a refund of the purchase itself — see below.

Refunds

You may request a refund of a credit pack within 14 days of purchase, provided the credits from that purchase have not been used. Credits that have already been spent on a generation are not refundable.

To request a refund, email support@animaker.dev from the address on your order, including your order number. We reply to refund requests within 3 business days.

Our payment provider, Creem, acts as the merchant of record for these purchases and processes the payment. Approved refunds are issued by Creem to the original payment method, and how quickly they appear depends on your bank or card issuer.

Nothing in this section limits any statutory right you may have, including any right of withdrawal available in your country.

Service Availability

We aim to keep animaker reliable, but the service may be interrupted by maintenance, provider outages, network issues, security events, or other factors outside our control.

We may modify, suspend, or discontinue parts of the service when needed.

Intellectual Property

The animaker website, product design, software, text, graphics, logos, and service features are owned by animaker or its licensors and are protected by applicable intellectual property laws.

These Terms do not transfer ownership of animaker technology, branding, or service materials to you.

Privacy

Our collection and use of personal information is described in our Privacy Policy.

Termination

We may suspend or terminate access to animaker if we believe you have violated these Terms, created risk for other users or the service, failed to pay applicable fees, or used the service unlawfully.

You may stop using the service at any time.

Disclaimers

animaker is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and uninterrupted operation.

Limitation of Liability

To the fullest extent permitted by law, animaker will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill arising from your use of or inability to use the service.

Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page. Continued use of animaker after changes become effective means you accept the updated Terms.
